Article 74-Ayatollah |
|
| 74.1 |
Executive regional government |
|
| |
The executive and regional power of Islam shall be vested in an executive government comprising the Ayatollah and the Regional Board of Directors (the Board). |
|
| 74.2 |
Ayatollah |
|
| |
The Ayatollah is the supreme regional leader of Islam, its regional representative to the world. The office of the Ayatollah is the highest regional elected office of Islam and at all times should be considered with the greatest dignity and respect. |
|
| |
It is from one of the Ayatollah come our great Caliph to represent the whole nation as one. They are our most respected, our most esteemed, our most revered. |
|
| 74.3 |
Qualification of Ayatollah |
|
| |
By the authority of this Constitution, only a person meeting all of the following criteria shall be permitted to stand for election to the office of Ayatollah: |
|
| |
(i) Is a Certified Imam according to the articles of This Constitution; and |
|
| |
(ii) That as a certified Imam, the candidate has been properly instantiated through the Official Ceremony- Supreme Initiation of the Powers and Authority of Imam; and |
|
| |
(iii) Is aged between 30 and 75; |
|
| |
(iv) Has had their primary residence in the Region for which they seek election for at least twelve (12) months |
|
| |
A person who fails one or more of these qualifications shall be ineligible to stand for election to the office of Ayatollah. |

| 74.4 |
Power of the Ayatollah |
|
| |
By virtue of this constitution and covenant, the Ayatollah of a region is vested with executive authority to manage the needs and affairs of Islam for their region through the selection or dismissal of wise counsel in the form of their Regional Board of Directors, the agencies, officials and administration of the regional government. |

| |
The Ayatollah shall have the authority of official spokesman for the word of Islam for the region during their time of office and all faithful must obey his command. |
|
| |
The Ayatollah shall have the authority over all agencies and Regional Directors as Chairman of the Regional Board of Directors. As Chairman of the Regional Board of Directors, the Ayatollah may choose to overrule motions of the Board and select the agenda and minutes of the Board meetings. |
|
| |
The Ayatollah shall have the power and authority to recommend an Imam to the position of head of an Assembly. However, it shall always be the right of an Assembly to block such recommended appointments. |
|
| |
The Ayatollah shall have the power by and with the advice and consent of the Regional Council to make statements of faith that once accepted may then become the basis of new regional law. |

| 74.5 |
Term of Ayatollah |
|
| |
The Ayatollah shall hold their Office during the term of four (4) years and be elected by regional election following the procedures for general and regional elections contained in this constitution. |
|
| |
The election of an Ayatollah shall be held in conjunction with the election of Regional Councillors of the same region. |
|
| |
All citizens of Islam in a region may vote for the election of the Ayatollah through secret ballot. The organisation of the election process shall be handled by the National Director for Fair Elections of Islam. |
|
| |
A person having been successfully elected Ayatollah four or more terms (16 years) shall be ineligible for any further elections as a Ayatollah. Furthermore, Ayatollah are expected to resign within 12 months of their 75th Birthday . |

| 74.6 |
Temporary Ayatollah |
|
| |
The position of Temporary Ayatollah exists when a Temporary Regional Council is formed under the articles of this Constitution and a permanent or temporary Imam is elected to such a position. |
|
| |
The office of Temporary Ayatollah dissolves under one of two conditions: |
|
| |
(i) The first official elections for Regional Council and Ayatollah according to the articles of this Constitution are held; |
|
| |
(ii) The Temporary Regional Council is not approved to a permanent Regional Council and its status is disbanded. |
|
| |
Under either conditions, the person holding the office of Temporary Ayatollah must relinquish all effective control. Failure to do so within fourteen (14) days of notice shall be grounds for automatic expulsion as a member. |
